Response: This is not a typical neighborhood situation along lakeshore and requires consideration and <br /> leniency of a variance for the homeowners' use and enjoyment. <br /> 10. The granting of the application is necessary for the preservation and enjoyment of a <br /> substantial property right of the applicant. <br /> Response: Granting this variance will allow the homeowner to enjoy the right to have adequate sunlight and <br /> views on the property and to maintain the property as it has been currently used. <br /> 11. The granting of the proposed variance will not in any way impair health, safety, comfort, <br /> morals, or in any other respect be contrary to the intent of the Zoning Code. <br /> Response: Granting this variance will not affect the health, welfare or safety of the community. It is in <br /> keeping with the zoning code. <br /> 12. The granting of such variance will not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate demonstrable difficulty. <br /> Response: Granting this variance would alleviate the practical difficulty of this particular property not working <br /> with the general intent of the average lakeshore setback ordinance. it is a unique property that needs to be <br /> looked at as a singular situation. <br />
