ARTICLE V <br /> NURP PONDS/DRAINAGE WAYS <br /> 1 <br /> Section S.l Easements. The Declarant hereby grants and conveys to the. Association,an <br /> easement over, under and across the real property depicted on Uhibit—attached hereto, and such <br /> additional real property of the Owners as is reasonably necessary to Sail, access to and froni the <br /> NURP Ponds/Drainage Ways. for the purpose of maintaining, repairing and restoring the NlJRP <br /> Ponds/Drainage Ways in accordance with all applicable rules, regulations and statutes. <br /> Section 5.2 Violation and WQ cement. <br /> 5.2.1 In the event the Association fails to conduct any required mstinteaance to the <br /> NURP Ponds/Drainage Ways or the Temporary Cul-de-sac, it is agreed by the Association <br /> and the afTected Owners that the City,may undertake such maintenance amt assess each Lot <br /> an equal. proportionate share of the matntenance conducted by the City. Any such <br /> maintenance conducted by the City will not remit in the NURP Ito nds/Drainage Ways <br /> becoming a public area. Each Owner will pay to the City its equal, proportionate can <br /> incurred by the City within thirty(30)days after Owner's receipt of such charges, or else such <br /> charge,including attorneys' fees and costs in collection thereof, shill become a lien upon the <br /> Lot for which payment has not been made. <br /> ARTICLE VI <br /> ENTRANCE MONUMENTS <br /> Section 6.1 fasgmsn.ts. The Declarant hereby grants and conveys an easetuent to the <br /> Association over,under and across the real property described on FxhibjL@ attached hereto for the <br /> purpose of maintaining, repairing and restoring the Entrance Monuments and the landscapinc, <br /> surrounding the Entrance Monuments. <br /> AW11CLE VII <br /> DUTIES OF ASSOCIATION <br /> Section 7.1 MAintsnariee h AgAr&fiQn. The Association shall provide the following <br /> maintenance: <br /> 7.1.1 Maintenance of any Entrance Monuments specific to Crystal Creek, and lite <br /> landscaping and grounds around Elie Entrance Monuments; <br /> 7.1.2 Maintenance,repair and replacement of the NUlti' Ponds it, accordance with <br /> all applicable rules, regulations and statutes. <br /> 7.1.3 Maintenance, repair and replacement, as necessary, of the Private Roadway <br /> and the Temporary Cul-de-sac, the costs for which shall be assessed arttong the Lots equally <br /> as a Common Expense Assessment. <br /> 7 <br />
