The long range Master Plan for the day camp is unique and create the need <br /> to an extended implantation timeline of 5 years. <br /> 10. "The granting of the application is necessary for the preservation and enjoyment of a <br /> substantial property right of the applicant." This property is located in a residential <br /> district but operates as a religiously affiliated children's camp. The setbacks <br /> variances requested are not necessary to preserve the enjoyment of the campers. <br /> 11. "The granting of the proposed variance will not in any way impair health, safety, comfort or <br /> morals, or in any other respect be contrary to the intent of this chapter." The used of the <br /> property, and along with all other proposed elements in the Master Plan, are <br /> intended to improve the health, safety, comfort, and morals of all users compared <br /> to the existing camp as it operates today. <br /> 12. "The granting of such variance will not merely serve as a convenience to the applicant, but <br /> is necessary to alleviate demonstrable difficulty." The applicants have developed a <br /> master plan to understand and adapt to the numerous regulations imposed on the <br /> property. The setbacks variances are deemed as a convenience to the applicant <br /> and the proposed buildings constructed in conforming locations. The extended <br /> timeline for the approvals are necessary for the implantation of the approved Master <br /> Plan. <br /> CONDITIONAL USE PERMIT ANALYSIS <br /> The Council finds that the proposed use at the proposed location is or will be: <br /> 1) Consistent with the community management plan; A camp is a listed use in the LB- <br /> 1B zoning district and is consistent with the community management plan. <br /> 2) Compliant with the zoning code, including any conditions imposed on specific uses as <br /> required by article V, division 3 of the City Code; This is met. <br /> 3) Adequately served by police, fire, roads, and stormwater management; This is met. <br /> The applicant is proposed to improve stormwater management on the property. <br /> Page 5 of 8 <br />
