In considering this application, the Council has considered the advice and <br /> recommendation of the Planning Commission and the effect of the proposed variances <br /> and CUP upon the health, safety and welfare of the community, existing and anticipated <br /> traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on <br /> values of property in the surrounding area. <br /> PRACTICAL DIFFICULTY ANALYSIS: <br /> 1. "Variances shall only be permitted when they are in harmony with the general purposes <br /> and intent of the ordinance . . . ." The request for the lakeyard setback and bluff <br /> setback variances are not in harmony with the Ordinance and the applicant has <br /> other opportunities to meet these setbacks. The applicant has failed to show that <br /> the buildings can't be located in an area that complies with the zoning ordiance. <br /> The use for a camp on this size property follows the general intent of the ordinance. <br /> The variance request to extend to timelines to 5 years meets the intent of the <br /> ordinance to allow time to implement the proposed Master Plan. <br /> 2. "Variances shall only be permitted . . . when the variances are consistent with the <br /> comprehensive plan."The proposed setback(lakeshore and bluff) encroachments for <br /> the proposed buildings do not further the goals of the comprehensive plan. The <br /> operational goals of the Camp TEKO Master Plan, the design team also proposed <br /> goals for entire the site in mind. These goals include design philosophies to <br /> maintain the natural character of the site, minimizing impacts such as hardcover, <br /> grading, tree removal, and the control of storm water runoff to Lake Minnetonka, all <br /> of which follows the City's Comprehensive Plan. <br /> 3. "Variances may be granted when the applicant for the variance establishes that there are <br /> practical difficulties in complying with the zoning ordinance. `Practical difficulties,' as used in <br /> connection with the granting of a variance, means that: <br /> a. The property owner in question proposes to use the property in a reasonable manner, <br /> however, the proposed use is not permitted by the official controls. <br /> The use and extended timeline for implementation of the Master Plan for the <br /> property is reasonable given the scope of the improvements.
