TO: Mayor Peterson and City Council
Ron Moorse, City Administrator
FROM: Jeanne A. Mabusth, Building & Planning Administrator
DATE: January 24, 1992
SUBJECT: Home Occupation License
Pertinent Sections:
Section 10.20, Subd. 4(C) ; Sections 5. 02 and 5.03.
List of Exhibits:
A. Home Occupation License Application
B. Applicants' Addendum
C. Staff Letter 1/2/92
D. Location Map
E. Survey of Existing Improvements
Review of Application
Mr. and Mrs. Dickey have made application for a Home Occupation
License to operate a management consultant company, known as Asbestos
Control Management, Inc., that involves the employment of independent
contractors licensed by the State for the removal of asbestos.
Applicants' addendum notes, Exhibit B, licensed contractors are part
of a pool that is drawn from when projects are contracted by the
management company operated from the Dickey's residence. It is
staff's understanding that Mr. Dickey has a license to also perform as
a contractor in the removal of asbestos. It was the storing of the
truck on the property that was first observed by the staff. The truck
is now housed in the Long Lake Industrial Park.
As Mr. Dickey has noted, the staff has visited the site to
observe the actual operation. The management portion of the property
of the business is conducted from an office within the residence.
Staff was escorted to the barn on Outlot A, Countryside Manor, to also
observe an equipment storage area used in Mr. Dickey's asbestos
removal operation. The barn currently houses horses owned by both the
Dickeys and customers of the Dickeys. The type of equipment stored in
the facility consists of poly, small vacs, filtration machines,
lights, ladders and miscellaneous tools. Staff noted to Mr. Dickey
upon the inspection of the barn that the shared use of the facility
with the horses presents issues for concern. Staff noted to Mr.
Dickey that the hazardous nature of the asbestos removal business will
present concerns for the Council and that staff will recommend that
all equipment associated with the asbestos removal phase of business
be stored off the residential property. The operation of the
management phase of the business is consistent with home occupations
approved for other residential property owners.
