�� . _.. .�* . <br /> � O� <br /> • O O <br /> �b. - CITY of 4RON0 <br /> � F <br /> ���: �G'�' RESOLUTION OF THE CITY COUNCIL <br /> � �kESH�4 NO. � �' � � <br /> A RESOLUTION DENYING VARIANCES <br /> TO MUNICIPAL ZOlvING CODE <br /> SECTIONS 10.03, SUBDIVISION 14(C); <br /> 10.22, SUBDIVISION 1 & 2, 10.55, SUBDIVISION 8; <br /> AND 10.56, SUBDIVISION 16(L) <br /> FILE #2137 <br /> WI�REAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City <br /> Council of the City of Orono has �dopted zoning regulations for the protection of the public <br /> health, safety and general welfare; and ' <br /> • WHEREAS, William Dunkley and Susan Dunkley (hereinafter "the applicants") <br /> are the owners of the property located at 2709 Walters Port Lane within the City of Orono <br /> (hereinafter "the City") and legally described as follows: <br /> Lot 4, Block 3, Walters Port, Hennepin County, Minnesota`(hereinafter "the property"); <br /> and <br /> WI�REAS, the applicants have applied to the City for variances to Municipal <br /> Zoning Code Section 10.03, Subdivision 14(C) to allow lot eoverage by structures to increase <br /> from the current level of 15.6% to 16.7% where only 15% lot coverage is normally allowed, <br /> and to Section 10.22, Subdivision 1(A) to allow construction of a room addition located 40' <br /> from the shoreline of Lake Minnetonka where a 75' setback is normally required, and to <br /> Section 10.22, Subdivision 1(B) to allow encroachment of the average lakeshore setback where <br /> no such encroachment is normally allowed, and to Sections 10.22, Subdivision 2, 10.55, <br /> Subdivision 8 and 10.56, Subdivision 16 (L) to allow an intensification of hardcover in the 0- <br /> 75' lakeshore setback zone where no hardcover is normally allowed, all of the above variances <br /> required for construction of a room addition housing swimming facilities attached to the <br /> existing residence structure; and <br /> Page 1 of 5 <br /> . <br />
