To: Street Files - 360 and 430 Wakefield Road <br /> From: Mike Gaffron, Planning Director <br /> 4 <br /> Date: April 7, 2003 <br /> Subject: Outlots D &E, Wakefield Farms 2nd Addition <br /> Synopsys: Outlots D &E were supposed to become part of 430 Wakefield Road. They have <br /> since been acquired by the owner of 360 Wakefield Road. An attempt to combine Outlots D <br /> & E with 360 Wakefield Road will require Council ap rp oval. <br /> We have received an inquiry regarding the potential for combination/division of Outlots D & E, <br /> Wakefield Farms 2nd, with Lot 6, Wakefield Farms 2nd (360 Wakefield Road) to create a new <br /> building site. <br /> Outlots D & E were created as part of the plat of Wakefield Farms 2nd Addition in 1990. A <br /> condition of plat approval (Resolution No. 1284) was that Outlots D & E were to be "legally <br /> combined for tax purposes with Lot 2, Block 1, Wakefield Farms (430 Wakefield Road) which <br /> together shall be thereafter considered as one building site." <br /> Outlot D was intended as additional potential septic site area for 430; Outlot E was added to the plat <br /> toward the end of the subdivision process,probably as part of an agreement between the subdivider <br /> and the owner of 430 at that time. <br /> Apparently, Outlots D&E never were legally combined with Lot 2,Block 1,Wakefield Farms. In <br /> 1990 Outlots D&E went tax forfeit.The City released them for sale to certain adjacent landowners <br /> specified in Resolution No. 2910; however, Lot 6, Block 1, Wakefield Farms 2nd Addition (360 <br /> Wakefield Road),was not one of the specified potential recipients. It is unknown whether this was <br /> on purpose or through error; it is also possible that certain laws may have prohibited the City from <br /> specifying which adjacent owners were eligible. <br /> At any rate,the owner of 360 has since acquired Outlots D&E but has not legally combined them. <br /> Such a leizal combination at this time would be in conflict with the conditions of Resolution No <br /> 1284 and would require Council approval.
