• <br /> O� <br /> i �- CITY of 0 ONO <br /> ra{tji� RESOLUTION OF THE CITY COUNCIL <br /> 0 NO. 2972 <br /> �IfESYi4L <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council <br /> hereby grants a variance to Municipal Zoning Code Section 10.03, <br /> Subdivision 9 (D) to allow an accessory building nearer the front <br /> or street lot line than the principal building on the property; <br /> and a variance to Section 10.28, Subdivision 5 (B) to permit <br /> construction of an above-grade encroachment-type deck attached to <br /> the house and located 22' from the side lot line where a 30' side <br /> lot line setback is normally required, subject to the following <br /> conditions: <br /> 1. Applicant is advised that any changes in plans from those <br /> submitted for this application review may require further <br /> City review. <br /> 2. Authorities granted by this variance run with the <br /> property not with the applicant, but are permissive only and <br /> must be exercised by application for a building permit <br /> within one year of the date of Council approval , or this <br /> variance will expire on that date (June 10, 1992). <br /> 3. Violation of or non-compliance with any of the terms and <br /> conditions of this variance shall constitute a violation of <br /> the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 4.
