/ O <br /> CITYof ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> `r`V, p4��' NO. 2 9 7 2 <br /> ESTI <br /> A RESOLUTION GRANTING <br /> VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.03, SUBDIVISION 9 (D) AND <br /> SECTION 10.28, SUBDIVISION 5 (B) <br /> FILE #1639 <br /> WHEREAS, Eleanor L. Ferri 1 (hereinafter "the <br /> applicant") is the owner of the property located at 240 Wakefield <br /> Road within the City of Orono (hereinafter "City") and legally <br /> described as follows: <br /> Lot 2, Block 1, Wakefield Farms Second Addition, Hennepin <br /> County, Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for a <br /> variance to Municipal Zoning Code Section 10.03, Subdivision 9 <br /> (D) to allow an accessory building nearer the front or street lot <br /> line than the principal building on the property; and a variance <br /> to Section 10.28, Subdivision 5 (B) to permit construction of an <br /> above-grade encroachment-type deck attached to the house and <br /> located 22' from the side lot line where a 30' side lot line <br /> setback is normally required. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #1639. <br /> 2. The property is located in the RR-1B Single Family Rural <br /> Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application <br /> on May 20, 1991, and unanimously recommended approval of the <br /> proposed variances based on the following findings: <br /> A) Because the house is located more than 250' from <br /> Wakefield Road, and because there is much vegetative <br /> screening between the street and house, the greenhouse <br /> will not appear as a front yard encroachment as viewed <br /> from the street. <br /> Page 1 of 4 <br />
