I I <br /> ORONO PLANNING COMMISSION MEETING <br /> MINUTES FOR SEPTEMBER 21, 1998 <br /> (#2401 Thomas and Margaret Radke, continued) <br /> Stoddard recommended limiting the size of the storage shed to 140 square feet. <br /> Berg stated she concurred with Stoddard. <br /> Stoddard moved, Lindquist seconded, to approve Application #2401, 3424 East Lake Street, <br /> granting of a variance to construct an accessory structure on Outlot B, the size of the <br /> structure to be limited to 140 square feet, per the concept plan submitted by the Applicants. <br /> VOTE: Ayes 3, Nays 2, McMillan and Smith opposed. <br /> (#3) #2403 TERRY CLARK, 1575 LONG LAKE BOULEVARD -VARIANCES AND CONDITIONAL <br /> USE PERMIT, 6:52 p.m. -7:08 p.m. <br /> Terry Clark and Architect Neil Weber were present. <br /> Van Zomeren stated the applicant is requesting variances for street yard setback, hardcover in the <br /> 0-75' setback, bluff setback, lakeshore setback, as well as a top of bluff setback variance. A <br /> conditional use permit is also required to alter the land in the 0-75' setback. <br /> The Applicant has submitted a revised proposal that would raise the existing residence four feet to <br /> allow for a walkout lower level, which would change the grade on the south side of the structure. <br /> This is a solution that has been reached in an effort to reduce the impact on the lake side of the <br /> property, and would add an additional 159 square feet in hardcover. <br /> • Weber stated the 0-75' setback will be affected no matter what design is proposed since the <br /> residence lies in the zone. Weber stated the current proposal is an effort to minimize the impact to <br /> the 0-75' zone as much as possible by raising the house up to add a walkout under a new deck on <br /> the lakeside of the residence. <br /> Chair Smith opened the hearing up for public comment. <br /> A resident of the area inquired about the impact the excavation would have on the adjoining <br /> properties, noting he has had standing water on his property in the past. <br /> Weber stated there will be very little excavation done except for the footings and under the deck. <br /> Van Zomeren stated City Staff is aware of the resident's concerns and has requested the City <br /> Engineer to review the plans. Van Zomeren stated the neighbor's current water problems are not <br /> related to this application and would need to be addressed separately. <br /> Chair Smith commented it is the Planning Commission's philosphy not to approve applications <br /> that would adversely affect the adjoining properties, noting the City Engineer feels it will not have a <br /> negative impact on the neighboring properties. <br /> Van Zomeren stated the ground elevations and amount of fill still need to be calculated. <br /> Stoddard commented he is in favor of the plan. <br /> Lindquist stated the Applicants have complied with what the Planning Commission had requested at <br /> the prior hearing, noting the ordinances governing hardcover were passed after the house was built. <br /> • McMillan stated she is concerned about major excavation in the 0-75' setback, noting this application <br /> Page 3 <br />
