Gaffron explained it is Orono's goal to bring <br /> sewer to all the property along the shoreline of Lake Minnetonka. Council has directed staff to make <br /> an application for an amendment of the MUSA boundary to incorporate the northeast shore of <br /> Maxwell Bay and the southeast shore of Stubbs Bay which remain unsewered. There is no estimated <br /> schedule when this might occur. Applicant is willing to construct a new system rather than wait for <br /> more than two years. <br /> Rappaport explained at the time of purchase the seller gave special consideration for replacement <br /> of the septic system. <br /> There were no public comments. <br /> Schroeder moved, Hawn seconded, to approve vacation of the existing easement and rededicate a <br /> new easement per staffs recommendation. Topography is an issue. The proposed retaining wall would be partially located <br /> within the lakeshore setback and on Hennepin County right-of-way. Permission from Hennepin <br /> County is needed. The roadway divides applicant's back yard and the lake. He proposes to neatly <br /> tie the retaining wall into the neighboring property and to provide safe access to the lake. Applicant <br /> has a concern for his children playing in the back yard by the top of the slope. <br /> Whitworth voiced his concern for safety of his children and access to the lake. He plans to have 3 <br /> terraces with a drop shorter than 5'. <br /> Berg asked if there would be a loss of mature trees. <br /> Whitworth said he would lose a couple of immature trees. <br /> 110 There were no public comments. <br /> 8 <br />
