0 <br />MINUTES OF THE ORONO PLANNING COMMISSION <br />MEETING HELD ON OCTOBER 20, 1997 <br />( #10 - #2301 Gerald McCourtney - Continued) <br />Gaffron indicated the hardship for the application is the wide right -of -way, the problem <br />with backing up vehicles, and problems with trespassing. <br />The expansion of the hardcover is outside of the property boundaries so a net decrease <br />will actually occur in the hardcover for the property. Gaffron provided a view of what <br />has occurred on the property and what is proposed. <br />Lindquist asked if the properties were one tax parcel. Gaffron said the combination is <br />pending court action. Council had given conceptual approval to the Brooks application <br />noted above. <br />McCourtney said it was his intention to combine the lots. Gaffron said the combination <br />should be a condition of approval. <br />Gaffron referenced a letter from the applicant regarding the hardcover removals. <br />Staff recommends approval of the hedge 15' from the paved roadway, the metal gate <br />subject to no paving or graveling of the approach to the gate, and expansion of the <br />• driveway with tradeoff of hardcover as already accomplished. <br />McCourtney had no additional comments. <br />Conley Brooks, Jr., reported living next door to the McCourtney property. He said he <br />acquired the other half of the Skarp property. He supports the proposal. He indicated his <br />recently approved plan and change from fencing to arborvitae as well for consistency in <br />looks for the neighborhood. He feels the proposal is in keeping with the characteristics of <br />the neighborhood. <br />Smith was informed that the access to the gate would be sodded and used by yard <br />workers to get their equipment off of the roadway. Smith questioned whether the sodding <br />should be stipulated. Gaffron said the condition notes no hard surface allowed. <br />McMillan asked why the gate is located in the right -of -way. Gaffron said it was close to <br />the 75' line. McCourtney said to move the gate out of the right -of -way would appear to <br />place it in the center of the property. He indicated he placed it as far back as possible. <br />Smith moved, Schroeder seconded, to approve Application #2301 per Staff <br />recommendations with the condition that the two properties be combined and the gate <br />area sodded. Vote: Ayes 6, Nays 0. <br />
