• ORONO PLANNING COMMISSION MEETING <br />MINUTES FOR SEPTEMBER 15,1997 <br />( #3 - #2294 LGA Investment Group - Continued) <br />Smith and Lindquist agreed there is concern with the runoff problem. Lindquist suggested the <br />applicant work with the City Engineer. While noting the developer is not responsible for the current <br />problems, they do, however, need to be corrected. <br />Lindquist moved, Schroeder seconded, to table Application #2294. Vote: Ayes 7, Nays 0. <br />(The meeting was recessed for 7 minutes.) <br />( #4) #2298 CONLEY BROOKS, JR. AND JOHN BROOKS, 905/980 FERNDALE ROAD <br />WEST - SUBDIVISION OF A LOT LINE REARRANGEMENT - PUBLIC HEARING 9:39- <br />10:21 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />The Applicant was present. <br />• Gaffron reported that the application is a request to detach Lot 13, North Shore Cottage Acres from <br />905 West Ferndale, and legally combine it with the Conley Brooks properties located across the <br />lagoon, Parcels A, E, H, and F. This is designated as a Class I subdivision as no plat is required as <br />it was previously platted. Gaffron indicated that the reattachment of the property to property across <br />the lagoon from it would be necessary. <br />• <br />It is the desire of the applicant to preserve his views across the lagoon. There is no structure located <br />in the 0 -75' setback. Some smaller trees on the peninsula may impact the views in the future. <br />Gaffron said Hennepin County would most likely not allow the legal combination with property <br />across the lagoon. This would then be subject to a special lot combination resolution to be filed on <br />the chain of title stipulating Lot 13 cannot be separated from the homestead parcel in the future <br />without City approval. This would eliminate the possibility of creating an unbuildable lot that could <br />be sold off. <br />Gaffron reviewed the three issues for consideration included in the packet on page 2 of the memo. <br />Smith was informed that the Shoreland District regulations control what occurs in the 0 -75' setback. <br />18 <br />
