OF A REGULAR MEETING HELD JULY 15, 1974 <br />Van Nest moved, Hake seconded, to recommend <br />ipproval on the following conditions: <br />1. Structure conform to new zoning <br />2. Engineer submit a drainage report <br />3. Landscaping plan be produced and bond <br />posted to insure installation according <br />to plan <br />Notion, Ayes (6) - Nays (0). <br />Thomas Betz represented himself in a petition <br />to vacate a City lake access, Lake Street <br />and G.1so part of County Road #84. Three years <br />ago, i:_lleeiedly due a surveyor's error, he found <br />he had const - =ted a residence in,such a manner <br />as to encroach on County Road #84 right -of -way <br />and the City Lake Street. The County Road #84, <br />through usage, has moved away from his house. <br />The County will vacate sufficient right -of -way <br />to the City which in turn would have to give <br />it to Betz. He proposed to exchange another 30' <br />access for the acquisition of 30' of Lake Street. <br />G<asch moved, Guthrie seconded, to have the <br />City Attorney investigate the ramifications <br />in such a transaction and report to the <br />- ommission before the August 19, 1974 meeting; <br />also, a public hearing on the matter to be <br />ordered.for that date. Van Nest added the <br />attorney should investigate the vacating of all <br />platted land presently under water. Motion, <br />Ayes (6) - Nays (0) . <br />Members studied Roy Starkey's proposed <br />division of two parcels of land from a <br />five -acre tract. Members could see no <br />need for a 50' public road dedication <br />since the property to the north abuts <br />Wayza•ca Boulevard. They proposed that he <br />dedicate a 50' Drivate easement along the <br />present driveway to the property in the <br />rear and move the division line as close <br />to the residence as legglly possible and <br />grant a variance if it is close to the <br />two -acre -roposed zoning. Furthermore, <br />that 11-r. Starkey bring in a plat made by a <br />registered surveyor showing exact dimensions <br />and square foot computations. <br />Pan Nest moved, Gasch seconded, that the <br />aiva.sion be allowed under the above conditions. <br />AlOtior_, Ayes (5) - Nays (1) .
