MINUTES OF A REGULAR MEETING HELD JULY 15, 1974 <br />Robert Bathke represented himself in an <br />application for a building permit. The <br />Building Inspector read a memo to the <br />Administrator, now on file, giving the <br />sequence of action taken from August 1,, <br />1971 to the present. Also shown, and on <br />file, is the list of people requesting the <br />permit be denied. <br />Attorney Jerome Rice, representing these <br />people, stated that on account of the lagoon <br />on the property, the lot could not be <br />built on without•a variance. He also <br />showed there were private easements for <br />viewing and walking across the property <br />granted to the property at 2610 Mapleridge <br />Lane, when Chris Dahl, the owner of this property <br />and 2610 Mapleridge Lane, sold the residence <br />at 2610 zapleridge Lane. Members reminded <br />Mr. Rice that the City did not have to honor <br />private covenants. On studying the plat, <br />it was felt that the lot was buildable without <br />granting a variance; also, that the only <br />hardship shown had to do with the private <br />easements. <br />Curtis moved, Kallestad seconded, that no <br />variance to the 75' setback required be <br />granted and owner should produce a new <br />site plan to conform to existing regulations. <br />Motion, Ayes (7) - Nays (0) . <br />William Dickey and his engineer showed the <br />plat of the proposed Farview subdivision. <br />Brought out was that the Lake Minnetonka <br />Conservation District has a moratorium on <br />multiple use of docks on properties serving <br />more than the owner. Mr. Dickey stated they <br />would abide with any regulation the L.M.C.D. <br />might come up with after their study. Sian Nest <br />felt that regardless of the L.M.C.D. multiple <br />use of the outlot should be forbidden. The <br />Chairman read the engineer's report and <br />recommendation on drainage for the sub- <br />division. Engineer Willis stated the geodetic <br />map did not show wetlands for the area. Van <br />Nest stated the Hickock water study showed <br />that Maxwell Bay as atrophic and the area <br />around it had one of the fastest runoffs, <br />stated at 199.7 cu. ft. per second in heavy <br />rains. He felt with some added cost more <br />water could be diverted to French Lake than <br />Shown on the plat plan. Van Nest felt that <br />the area should be kept as much as possible <br />in its natural state.and that the road near <br />Leaf Street as proposed would affect runoff <br />contrary to engineer's report.
