�ONp CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> 7P NO. 7000 <br /> G <br /> SH0 <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1279 <br /> FILE NO. LA19-000043 <br /> WHEREAS, on May 22, 2019, Joanne Pastel (hereinafter the "Applicant"), applied <br /> for variances from the City Code for the property addressed 951 Spring Hill Road and legally <br /> described as: <br /> That part of Government Lot 3, Section 26, Township 118 North, Range 23 <br /> West of the 5th Principal Meridian, lying Southerly of a line described as follows: <br /> Commencing at the Southeast corner of said Government Lot 3; thence North along <br /> the East line of said Government Lot 3 a distance of 70 feet; thence deflecting left <br /> 76004' a distance of 950 feet to the point of beginning of the line being described; said <br /> point being referred to as "Point A'; thence continuing on the last-said course to the <br /> West line of said Government Lot 3, and there ending; and Westerly of a line described <br /> as beginning at said "Point A" and running thence Southwesterly perpendicular to the <br /> above-described Northerly property line, to the South line of said Government Lot 3 <br /> and its Westerly extension, and there ending, Hennepin County, Minnesota. <br /> (hereinafter the"Property"); <br /> WHEREAS, the Applicant has made application to the City of Orono for variances <br /> to Orono Municipal Zoning Code Section 78-1379 to allow construction of a garage addition 98 <br /> feet from the ordinary high water level (hereinafter the "OHWL") and a deck stair 97 feet from the <br /> OHWL where a 100-foot setback is required from Long Lake, and <br /> WHEREAS, on June 17, 2019, after published and mailed notice in accordance with <br /> Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br /> time all persons desiring to be heard concerning this application were given the opportunity to <br /> speak thereon; and <br /> WHEREAS, on June 17, 2019, the Planning Commission recommended approval <br /> of the variances; and <br /> WHEREAS, on July 8, 2019, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> I <br />
