It is my <br /> understanding that Dvorak, et al, is intending to sell Tract I with the existing house, and keep Tract <br /> J for the purported purpose of maintaining a dock. I want you to be aware of the following issues: <br /> 1. The City will oppose any sale of the two Tracts separately for the following reasons: <br /> a. Building permit #3026 was issued for construction of the residence on <br /> October 11, 1974 specifically based on Tracts I and J being combined to meet <br /> zoning lot area requirements. Permit#3022 was issued earlier that same day <br /> based on use of Tract I only, and then voided. A building inspector's memo <br /> of August 21, 1974 confirms this was the City's intent. <br /> b. The City assessed 1/2 sewer unit to each of Tracts I and J for the 1970 Saga <br /> Hill sewer project, Levy#5382. This is further evidence that the two parcels <br /> were intended to be used as a single entity. <br /> 2. The Orono Zoning Code since 1968 has prohibited the construction and use of <br /> accessory structures (including docks) without a principal structure on the property <br /> (See Section 10.03, Subd. 9(A) attached). If Dvorak retains Tract J without a <br /> principal residence structure, any dock on Tract J will be illegal, and the City will <br /> vigorously pursue its removal. I would refer you to a recent similar situation in which <br /> the Minnesota Court of Appeals upheld the City of Orono's right to enforce this <br /> ordinance (Richard Stodola vs City of Orono, 1994). <br /> 3. Tracts I and J together comprise approximately 0.75 acres in area. This area of Orono <br /> is zoned LR-1B requiring 1 acre minimum lot size.
