� ` - r. <br /> � � O� <br /> O ' O <br /> • - g , , � CITY of ORONO <br /> � � <br /> ,� t � <br /> � G RESOLUTION OF THE CITY COUNCIL <br /> �`�kESI3�g'� NO. � � � � <br /> A RESOLUTION GRANTING A <br /> CONDITIONAL USE PERMIT <br /> PER MUNICIPAL ZONING CODE <br /> SECTION 78-1431 <br /> FILE NO. 03-2941 � <br /> WHEREAS, Paul David Cady and Judith Lynn Rauch�zarter-Cady, <br /> husband and wife (hereinafter "the applicants") are the owners of the property located at � <br /> 46� Turnham Road within the City of Orono (hereinafter the "City") and legally <br /> described as follows: <br /> Lot 1, Block 3, Turnham Toll Addition, Hennepin County, Minnesota <br /> (hereinafter the "property"); and <br /> • WHEREAS, the applicants have made application to the City of Orono <br /> for a conditional use permit per Orono Municipal Zoning Code Section 78-1431 to allow <br /> construction of a barn on a through lot. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File�03-2941. <br /> V <br /> 2. The property is located in the RR — 1 A, One Family Rural Residential <br /> District which requires a minimum lot azea of S acres where the <br /> applicants' property is 5.948 acres. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on October 20, 2003 and recommended approval of the conditional <br /> use permit based on the following findings: • <br /> a. The barn if constructed in the location indicated on the subm.itted plans <br /> will meet the required 75' setback from all property boundaries. <br /> • <br /> Page 1 of 5 <br />
