We have also reviewed reports from two structural engineers. Your engineer <br /> felt it should be investigated further. The builder's engineer felt it was only a cosmetic crack. <br /> The City's position is that this is probably a cosmetic crack and will not affect the structural integrity <br /> of the building, so the city will not take any action at this time. If however a structural problem <br /> occurs (which would probably happen during the first year freeze thaw cycle), the contractor would <br /> be required to repair it under a ten year structural defect warranty required by state statutes. If the <br /> contractor failed to repair it and you were unable to enforce a judgment against him(if he was out <br /> of business for example), you could collect from the State Commerce Department's recovery fund <br /> and have it repaired.
