While my clients <br /> appreciate your efforts to help them resolve the problems with their home, a few matters require <br /> further attention. <br /> I am in receipt of a copy of Roger Olson's letter to you dated October 1, 1998. As you aware, <br /> Mr. Olson refuses to correct the defects and problems listed in your letters of September 2, 1998 <br /> and September 15, 1998. You recently informed my clients that while you intend to discuss a <br /> number of the defects further with Mr. Olson, you also intend to seek correction of other defects <br /> directly from Mr. Olson's sub-contractors. The Acnes have expended untold amounts of time <br /> and money seeking a home that complies with their contract with Mr. Olson, as well as the <br /> Building Code. The Arrres want the problems with their home fixed, and if the sub-contractors <br /> are willing to do so, the Acnes would be satisfied with that resolution,. However, my clients are <br /> concerned with the City allowing Mr. Olson to wally away from any of the problems he is <br /> responsible for. It is the City's obligation to ensure compliance with the Building Code and the <br /> requirements stated in your letters to Mr. Olson. <br /> In particular, the Ames are concerned with the defective front stoop and the defective septic <br /> system located on the above-referenced property. In his October 1, 1998 letter to you, Mr. Olson <br /> states that the crack in the stoop is "cosmetic and not structural."Mr. Olson's assertion is not <br /> only false, but does not address the full scope of the problems with the stoop.
