s
October 1, 1998
Mr. Lyle Oman
City of Orono RECEIVED
P.O. Box 66
Crystal Bay,MN 55323-0066 OCT 0 5 1998
Re: Your letter of September 2, 1998 on 125 Truffula Trail,Orono Cly Y Ur ORONO
Dear Mr.Oman:
On October 23 1997 RKO Builders completed construction, and with a Certificate of Occupancy from the
City of Orono transferred the title on the above property to the Ame's.
A Certificate of Occupancy means that the"building substantially conforms to the requirements of the
ordinances of the City". The property was accepted by the homeowners and approved by the Mortgage
Company.
Having said that, and on the advice of legal counsel,I am responding to your letter as follows:
• RKO Builders had a licensed engineer inspect the crack in the front stoop who stated that it was
cosmetic and not structural.
,F • The patio doors where inspected by the door manufacture. If they felt there was something wrong with
the installation they should have taken care of it. This is a manufacturer's warranty problem not a
code violation.
• Missing caulking was done or should have been done by Suburban exteriors in Orono I have contacted
them many times and they have been to the site, met with the home owner and caulked places
missed.
• The Class B flue was inspected and approved by the city inspector.
• The air conditioner was installed under the porch at the insistence of the homeowner. If the
homeowner wants this air conditioner moved he should pay for it.The clearance problem is a
manufactures requirement not a code violation.
rf • The roof vents were not clogged when we installed them.
0 Heating system was inspected and approved by the city. If the city feels that there is a problem they
should contact the heating contractor. This is not a code violation.
• The roof shingles, shingle tins, ice and water shield and valley flashing have been installed per code.
The water leakage was from ice back up and was inspected and stopped by the roofing contractor.
After meeting with the city inspector we determined that a flashing going up higher on the wall then
the shingle tins would most likely solve the problem. On June 12, 1998 1 went out to 125 Truffula Trail
and began to make the changes to the flashing that the Inspector and I had agreed on.When Mike Arne
arrived home he asked me what I was doing. I told him.He said that's not how he wants it done and if
that's how I was going to do it I should get off his roof and if I came back without his knowing he
would consider it trespassing. The roof flashings were not changed at the homeowner's request.
• The mound septic system was installed under the direct supervision and in the location determined by
the city Inspector. The installer did everything that the inspector wanted and followed the plan
carefully. The system is working and meets all the state and local standards.
