Box 66 <br /> Crystal Bay,MN 55323-0066 OCT 0 5 1998 <br /> Re: Your letter of September 2, 1998 on 125 Truffula Trail,Orono Cly Y Ur ORONO <br /> Dear Mr.Oman: <br /> On October 23 1997 RKO Builders completed construction,and with a Certificate of Occupancy from the <br /> City of Orono transferred the title on the above property to the Ame's. <br /> A Certificate of Occupancy means that the"building substantially conforms to the requirements of the <br /> ordinances of the City". The property was accepted by the homeowners and approved by the Mortgage <br /> Company. <br /> Having said that,and on the advice of legal counsel,I am responding to your letter as follows: <br /> • RKO Builders had a licensed engineer inspect the crack in the front stoop who stated that it was <br /> cosmetic and not structural. <br /> ,F • The patio doors where inspected by the door manufacture.If they felt there was something wrong with <br /> the installation they should have taken care of it. This is a manufacturer's warranty problem not a <br /> code violation. <br /> • Missing caulking was done or should have been done by Suburban exteriors in Orono I have contacted <br /> them many times and they have been to the site,met with the home owner and caulked places <br /> missed. <br /> • The Class B flue was inspected and approved by the city inspector. <br /> • The air conditioner was installed under the porch at the insistence of the homeowner. If the <br /> homeowner wants this air conditioner moved he should pay for it.The clearance problem is a <br /> manufactures requirement not a code violation. <br /> rf • The roof vents were not clogged when we installed them. <br /> 0 Heating system was inspected and approved by the city. If the city feels that there is a problem they <br /> should contact the heating contractor. This is not a code violation. <br /> • The roof shingles,shingle tins,ice and water shield and valley flashing have been installed per code. <br /> The water leakage was from ice back up and was inspected and stopped by the roofing contractor. <br /> After meeting with the city inspector we determined that a flashing going up higher on the wall then <br /> the shingle tins would most likely solve the problem.On June 12, 1998 1 went out to 125 Truffula Trail <br /> and began to make the changes to the flashing that the Inspector and I had agreed on.When Mike Arne <br /> arrived home he asked me what I was doing. I told him.He said that's not how he wants it done and if <br /> that's how I was going to do it I should get off his roof and if I came back without his knowing he <br /> would consider it trespassing. The roof flashings were not changed at the homeowner's request. <br /> • The mound septic system was installed under the direct supervision and in the location determined by <br /> the city Inspector.The installer did everything that the inspector wanted and followed the plan <br /> carefully. The system is working and meets all the state and local standards. <br />
