MEMORANDUM <br /> To: Street File 1355 Tonkawa Road <br /> From: Mike Gaffron, Asst. City Administrator <br /> Date: September 27, 2013 <br /> Subject: Hardcover Review per Revised Hardcover Ordinance <br /> In September 2012 the City Council adopted Ordinance 94, 3rd Series which made significant <br /> changes to the City's hardcover ordinances. Specifically relative to the situation at 1335 Tonkawa <br /> Road,the new Ordinance allows hardcover credit for the area of the 0-75' setback zone of lakeshore <br /> lots. While hardcover allowed within that zone is strictly limited,the additional creditable area adds <br /> to the overall hardcover allowed on lakeshore lots. <br /> A review of the hardcover on this property in 2003 after construction revealed excessive hardcover <br /> within the 75-250' zone, as follows: <br /> 0-75': 25 s.f. /11,582 s.f. =0.2% <br /> 75-250': 8,612 s.f. /25,897 s.f. in 75-250' zone= 33.3 %(25%allowed) Excess =2,138 s.f. <br /> 250-500': 323 s.f. /2,294 s.f. in 250-500' zone= 14.1 %(30% allowed) <br /> An in-house review of the hardcover numbers based on the 2012 code revisions yields the following: <br /> Total hardcover=25s.f. + 8,612 s.f. + 323 s.f. + 156 s.f. (Patio at 100%HC)=9,116 s.f. <br /> Total lot area= 11,582 s.f. +25,897 s.f. +2,294 s.f. =39,773 s.f. <br /> 9,116 s.f. /39,773 s.f. =22.9 % (25% allowed) <br /> Under the new ordinance, the property has a conforming hardcover percentage based on the 2003 <br /> hardcover observations. <br /> Therefore, the Permit Hold placed on the property on 8/24/2009 may be removed. <br />
