i <br /> October 2004 the property owners were involved in the land use application review process as a result <br /> of conducting land alterations, hardcover installation and retaining wall construction without permits. <br /> Ultimately the property owners received an after-the-fact conditional use permit and after-the-fact <br /> hardcover variances in order to complete the grading and retaining wall work in accordance with the <br /> City Engineer's ineer's recommendations and in conjunction with 800 s.f. of hardcover removals within the 0- <br /> 75' zone. We find it surprising that the Ebertzs claim to be unaware of the need for permits. <br /> COUNCIL ACTION REQUESTED <br /> II <br /> Council should deny the appeal and allow continued enforcement of City code including deck <br /> removal, or direct staff to allow the property owners to apply for an after-the-fact variance and <br /> continue along that path. <br /> Should the Council findings remain consistent with those of staff lease provide the property owner <br /> g p <br /> and staff with a deadline for removal. <br />
