O 4 <br /> CITY of ORONO <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> �L`4k'ESI'iO4�G NO. <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-1288 AND A CONDITIONAL <br /> USE PERMIT PURSUANT TO MUNICIPAL <br /> ZONING CODE 78-1286 <br /> FILE NO. 07-3317 <br /> WHEREAS, Erik G. Swenson and Heidi R. Swenson, husband and wife <br /> are the owners of the property located at 774 Tonkawa Road and Hessburg Development, <br /> a domestic corporation who has interest in the property at 774 Tonkawa Road <br /> (collectively and hereinafter "the Applicants") within the City of Orono (hereinafter the <br /> "City") and legally described as follows: <br /> All that part of PARTENS'S POINT FIRST DIVISION, lying southeasterly of a <br /> line drawn from a point on the southwesterly line of said Lot 14, distant 51.34 feet <br /> northwesterly of the southwesterly corner of said Lot 14 to the shore of Lake <br /> Minnetonka, said line being parallel to the northwesterly and southeasterly lines <br /> of said Lot 14, Hennepin County, Minnesota <br /> (hereinafter the"property"); and <br /> WHEREAS, in 2005, by Resolution No. 5377, the Applicants received <br /> variances to the City of Orono Sections 78-330 (B) and 78-1288 to allow construction of <br /> a new residence on an existing lot with a lot area of 0.36 acres when 1.0 acres is normally <br /> required, a lot width of 74' at the shoreline and 61' at the 75' setback when 140' is <br /> normally required, 27.2% hardcover within the 75'-250' zone when 25% is normally <br /> allowed and 27.2% previously existed, and lastly 39.4% hardcover within the 250'-500' <br /> zone where 30% is normally permitted and 66.8%previously existed; and <br /> WHEREAS, the Applicants have made application to the City of Orono <br /> for after-the-fact variances to Orono Municipal Zoning Code Sections 78-1288 to allow <br /> 6.8% hardcover within the 0-75' zone where 5.2% was previously approved, and 30.3% <br /> hardcover within the 75'-250' zone where 27.2%was previously approved in conjunction <br /> with necessary site grading changes made during the construction of a new residence on <br /> an existing lot; and <br /> WHEREAS, the Applicants have made application to the City of Orono <br /> for an after-the-fact conditional use permit pursuant to Orono Municipal Zoning Code <br /> Page 1 of 5 <br />
