O � <br /> CITY of ORONO <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> 04�G NO. <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-330, 78-1279 and 78-1403 <br /> FILE NO. 09-3414 <br /> WHEREAS, Patrick Middleton and Kathleen Middleton, husband and wife <br /> (hereinafter"the applicants") are the owners of the property located at 720 Tonkawa Road within <br /> the City of Orono (hereinafter the "City") and legally described as follows: <br /> Attached as Exhibit A, Hennepin County, Minnesota (hereinafter the "property"); <br /> and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-330 to allow construction of a second- <br /> story addition over the existing home located 7.4 feet from the side lot line where a 10 foot <br /> setback is required; and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a second- <br /> story addition over the existing home located forward of the average lakeshore setback line; and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1403 to allow construction of a 4'x4' <br /> covered porch addition above a relocated entry door resulting in a proposed structural coverage <br /> level to be 17.85%where 15% is allowed and 17.73% currently exists. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 09-3414. <br /> 2. The property is located in the LR-1B, One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acre and a minimum lot width <br /> of 140'. <br /> Page 1 of 5 <br />
