Item #01- Special Council Meeting - 01106114 <br />File #13-3638 & 13-3639 [Total Pages 99] <br />MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Tuesday, November 12, 2013 <br />7:00 o'clock p.m. <br />(8. #13-3638 and 133639 SOURCE LAND CAPITAL, LLC (PAT HILLER) OIBIO GRANT <br />WENKSTERN (LAKEVIEW GOLF), 405 NORTHARMDRIVE, COMPREHENSIVE PLAN <br />AMENDMENTAND SKETCH PLANREVIEW, Continued) <br />Staff is recommending approval of the Comprehensive Plan Amendment and finds the following: <br />The existing land use designation no longer provides a viable use of land for a private property <br />owner. <br />2 The land use designation, in this case, unreasonably restricts the owner's use of the land in an <br />economically viable way. <br />The restriction to the current designation places an inordinate burden on the landowner to provide <br />public open space. <br />4. The surrounding land uses are dominated by rural density residential uses, along with some urban <br />residential uses. <br />5. The area is not within the MUSA, in which public sanitary sewer would be available for urban <br />densities. <br />6. The area is within the northwest portion of the City, in which road uses and densities are <br />designated. <br />The most appropriate use for the subject project is Rural Residential, reflecting the policies of the <br />Community Management Plan and the existing zoning of the property. <br />McMillan asked if the applicant can begin any work on the preliminary plat during this comment period <br />for the Comprehensive Pian amendment. <br />Grittman stated the applicant can proceed with work on the site but that they do so at their own risk. <br />McMillan asked if there would be an opportunity to look at the preliminary plat at the same time as <br />adoption of the amendment. <br />Grittman indicated that is probably more local practice and that he would defer to Staff on that. Grittman <br />noted the Council would not be able to take action on the plat until the Comprehensive Plan amendment <br />is adopted. <br />City Attorney Poehler indicated the Council could do it concurrently if they chose. <br />Printup asked why this area was originally guided recreational and open space in the Comprehensive <br />Plan. <br />Page 13 of 36 <br />
