The land use designation, in this case, unreasonably <br />restricts the owners' use of the land in an economically <br />viable way. <br />c. The restriction to the current designation places an <br />inordinate burden on the landowner to provide public open <br />space. <br />d. The surrounding land uses are dominated by rural density <br />residential uses, along with some urban residential uses. <br />e. The area is not within the MUSA, in which public sanitary <br />sewer would be available for urban densities. <br />f. The area is not within the northwest portion of the city, in <br />which rural uses and densities are designated. <br />g. The most appropriate use for the subject project is Rural <br />Residential, reflecting the policies of the Community <br />Management Plan and the existing zoning of the property. <br />Consequences of an approval first would result in submission of the Comp <br />Plan Amendment to surrounding communities for review and comment, <br />and then to the Metropolitan Council. Met Council's obligation is to <br />making a determination as to whether the proposed amendment is <br />consistent with the regional planning documents within its areas of <br />jurisdiction — primarily Housing, Parks, Transportation, Sewers and <br />Surface Water Management. <br />Following Met Council review, the City Council would formally adopt the <br />amendment, which then would lead, presumably, to an application for a <br />Preliminary Plat. Other zoning applications may be included as part of the <br />subdivision application. To submit a Preliminary Plat request, the <br />applicant will need to prepare all of the supporting documents identified in <br />the City's Subdivision Ordinance, including engineering and other plans <br />necessary to ensure that the plans meet the City's (and other agencies') <br />requirements. <br />4 <br />
