<br />NOW, THEREFORE, this indenture witnesseth, in consideration of One Dollar
<br />and other good and valuable consideration, paid by the Grantee to the Grantor W ,

<br />grant(s) unto the Grantee, its successors and assigns forever, a perpetual underground

<br />ginning of the centerline being described; thence deflecting
<br />left 39030' a distance of 17.8 feet; thence deflecting right 100
<br />25' a distance of 100 feet; thence deflecting left 53051' a

<br />of 86 feet; thence deflecting left 71049' to the shore of Lake
<br />Minnetonka, and there ending.
<br />including, but not by way of limitation a full and free right and authority to enter
<br />upon said land to construct, install, maintain, operate and repair a.sass3taa�c -�•�' i;f«
<br />ctatioa, sanitary sewer interceptor, sanitary sewer main or line, and any and all
<br />appurtenances incidental and related thereto, (such are hereafter collectively referred
<br />to as the Improvement), and to join connections to said Improvement, and the Grantee
<br />shall have the right to make such use of said land as is reasonably necessary and advis-
<br />able to the construction, installation, maintenance, operation and repair of the
<br />Improvement.
<br />By acceptance of this easement and in consideration therefor, the Grantee
<br />for itself and its successors and assigns covenants and agrees to restore the surface
<br />of the ground of said land where such is physically possible and practical, to approx-
<br />imately the same condition that existed prior to any construction, installation, main-
<br />tenance or repair of the Improvement within a reasonable time thereafter unless weather
<br />or circumstances beyond Grantee's control do not permit.
<br />The Grantor(a) hereby covenant(s) for himself and his
<br />successors, heirs and assigns, to refrain from performing any act on or constructing or
<br />erecting any fixture or improvement on said land that would interfere with Grantee's
<br />right of construction, installation, operation, maintenance and repair of the Improvement.
<br />IN TESTIMONY WHEREOF, the said Grantor has caused these presents to be
