All exterior lighting shall be so directed so as not to cast glare toward or onto the <br />public right-of-way or neighboring residential uses or districts; There should be no <br />lighting or glare resulting from the grading project and <br />15. Not detrimental to the public health, public safety, or general welfare. The Applicant <br />will be required to keep debris off of the public roadways. The noise resulting <br />from the trucks hauling and equipment moving the material in and around the <br />site should be minimized to the extent possible. The grading project will be <br />monitored by the City Engineer and planning staff so as to minimize nuisances <br />during the project. <br />A CUP may be granted subject to such conditions as the Council may prescribe. Additionally, <br />a CUP shall remain in effect as long as the conditions imposed by the City Council are <br />observed, but nothing in this section shall prevent the city from enacting or amending official <br />controls to change the status of conditional uses. <br />Additionally Section 78-1286(e) provides guidance for the granting of a conditional use permit <br />in the Shoreland Zone. Specifically, 78-1286(e) states the following: <br />1. Grading or filling in any type 1, 2, 3, 4, 5, 6, 7 or 8 wetland must be evaluated to <br />determine how extensively the proposed activity would affect the following functional <br />qualities of the wetland: The grading impacting the small interior wetland appears <br />to be supported by WCA, whose review is ongoing. The wetland maybe <br />impacted by the creation of the two beaches. <br />2. Alterations must be designed and conducted in a manner that ensures only the <br />smallest amount of bare ground is exposed for the shortest time possible. The <br />applicant will be required to adhere to the City's erosion control regulations as <br />well as the permitting requirements of the MCWD. <br />3. Mulches or similar materials must be used, where necessary, for temporary bare soil <br />coverage, and a permanent vegetation cover must be established as soon as <br />possible. The applicant will be required to adhere to the City's erosion control <br />regulations as well as the permitting requirements of the MCWD. Timely re - <br />vegetation and stabilization will be a requirement of the permitting process. <br />4. Methods to minimize soil erosion and to trap sediments before they reach any surface <br />water feature must be used.
