CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION <br />APPROVING VARIANCES, CONDITIONAL USE PERMITS AND <br />EASEMENT VACATION FROM MUNICIPAL ZONING CODE <br />SECTIONS 78-1605, 78-1282, 78-1126, 17-1286, 17-967, AND 78-1610 <br />FILE NO. 17-3988 <br />17-3989 <br />17-3990 <br />WHEREAS, on October 18, 2017, Lake West Development LLC o/b/o Rick and <br />Barbara Lupient ("Applicants"), applied for a variance from the City Code for the property identified <br />by PIDS: 2011723420003, 2011723420002 and 2011723420001 "Ivy Place" and legally <br />described as: <br />Lots 1,2,3 Block 1 Casco Point Addition (hereinafter the "Property"); <br />WHEREAS, on November 8, 2017 the application was deemed complete; and <br />WHEREAS, the Applicants have made application to the City of Orono for <br />variances to Orono Municipal Zoning Code Section 78-1605 and 78-1282 to allow a <br />setback from the wetland and to allow the driveway in shoreland overlay district to exceed <br />8 feet in width; and <br />WHEREAS, the Applicants have made an application to the City of Orono for <br />condition use permits to Orono Municipal Zoning Code Sections 78-1126, 78-1286, 78-967, <br />78-1610 in order to allow for bringing fill into the floodplain, moving over 50 cubic yards in the <br />lake yard setback, altering over 500 cubic yards in the shoreland overlay district and altering <br />portions of wetlands; and <br />WHEREAS, the Applicants have made an application to the City of Orono for <br />vacation the following easements: <br />sanitary sewer document # (Document 855727) <br />utilty easement, document # (Document 862192) <br />WHEREAS, on November 20, 2017, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br />
