The existing utility easement to be <br />vacated, will in actuality be relocated to better protect the existing utility in place. <br />c. 17-3990: Approval for the proposed Conditional Use Permits for filling 1000+CY of fill in the <br />floodplain, moving over 50 CY of earth within the 75 foot lakeyard, and 500 CY within the <br />site, wetland alterations for filling in a small wetland and beach improvements contingent on <br />the following: <br />1. Final plat approval <br />2. Approval for all permits related to the MCWD <br />3. Applicant shall receive approval from the DNR Commission prior to received land <br />alteration permit <br />4. WCA Approval <br />5.No parking on Ivy Place at any time <br />6. Beach Improvements stall be limited to the project scope. <br />7.A review of the road condition must be done before and after construction, <br />any damage will be repaired by developer. <br />8. Hauling hours are limited to 7:30-3:OOpm and 4:OOpm-8:OOpm while school <br />is in session. <br />9. Confirm the location of the delineated wetland (See Exhibit Q <br />5. Public Comment. Comments from the public were received regarding this application; refer to the draft <br />Planning Commission minutes for more detail. The neighboring resident was concerned that the driveway <br />would encroach into the wetland, and wanted clarification. This clarification is provided as Exhibit C, <br />showing the wetland boundary, driveway limits, and the easement.... <br />6. Staff Recommendation. Staff notes that the creation of a beach may require additional wetland <br />mitigation. Staff recognizes that the use of the property requires the requested applications, and they are <br />the minimum necessary to use the property for its intended use. Staff supports the conditions intended to <br />mitigate negative impacts associated with the project.
