We will be <br />on vacation during the council meeting on November 13th, or we would attend. Please use my <br />comments during the discussion as I feel they are valuable. <br />I would like to start out explaining that I own and operate a property management company in <br />the Twin Cities, specifically dealing with townhome and condominium association <br />management. I fell this gives me lots of background on this subject as each community we <br />manage has their own governing documents and board of directors, similar to any city. We <br />have been discussing this item in depth as the Super Bowl is among us. Most HOA's ban <br />'transient hotel usage' which would be considered any tenant that is not staying longer than the <br />lease term set by the association. (3 months to 1 year for most HOA's). <br />I personally feel that adding this restriction is removing a right we had as a homeowner when <br />we purchased the home. While I understand that laws may be implemented at any time, this is <br />one which affects my rights as a homeowner. <br />Instead of fully banning the short term leasing, why not put restrictions on it? In some of the <br />HOA's we manage, we have put harsh rental restrictions on the owners for not following <br />guidelines, which can then be passed on to the renters. For instance, one community we <br />manage has a $1,000 fine without warning for any unit which does not abide by the guidelines <br />set by the rules and regulations. It is mandatory that the renters sign off on this, and pay a <br />deposit up to this amount to the landlord in case of any mishaps. Similar to a rental license in <br />other cities, Orono could implement a license with stipulations. The license could be pulled if <br />any of the stipulations are broken, and/or a fine could be assessed. <br />After hearing of the nuisances of the subject property, it seems that the owner of that property <br />is not taking responsibility of the tenants, and the owner should most definitely be held liable <br />for the inappropriate behavior which is occurring there; but should not punish the rest of the <br />community for their actions. <br />As a homeowner who is looking into using their primary residence to rent out a handful of <br />times per year on a site such as AirBnB.com, it is in my best interest to make sure that the <br />current tenants are using the property in the correct manner. <br />How is this going to be policed if a full restriction in place? I also use my property to hold <br />several events throughout the year with family and friends, some of which do not involve me <br />being present at the function. What will the complaint/investigation look like? What will stop <br />homeowners from renting to someone for 30 days, but having a backdoor agreement to only <br />staying for 3? What currently happens to homeowners which hold parties similar to the subject <br />property? are they penalized in some way through city law? <br />I have an acquaintance who rented a property thought the summer on Lake Minnetonka (not in <br />
