MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, October 16, 2017 <br />6:30 o'clock p.m. <br />8. 17-3975 KELLY HANSON, 1284 WILDHURST TRAIL, CONDITIONAL USE PERMIT, <br />8:42 P.M. — 8:45 P.M. <br />Kelly and Tom Kahlert, Applicants, were present. <br />Curtis stated the applicant is requesting a conditional use permit for a permanent dock installation. The <br />applicant is currently building a new home on the vacant property and would also like to install a <br />permanent dock. Because of the permanent nature of the dock within the floodway, a conditional use <br />permit is required. The LMCD regulates docks on Lake Minnetonka and has not yet processed the <br />application fully. However, it appears the proposed dock will meet all of their setbacks. <br />The conditional use permit analysis was provided in Staff's report. There are no specific building code <br />construction standards for docks. The City does require that a zoning permit be issued for the dock to <br />document the existence and construction of a permanent dock on the lake. <br />Staff recommends approval of the conditional use permit for construction of the proposed permanent dock <br />subject to the following conditions: <br />The dock may be allowed as long as it continues to be permitted by the LMCD and DNR and is in <br />conformity with the rules and regulations of those agencies; and <br />2. The dock is not to be used for commercial purposes or rented. <br />Kelly and Tom Kahlert stated they can answer any questions the Planning Commission may have. <br />Chair Thiesse opened the public hearing at 8:44 p.m. <br />There were no public comments relating to this application. <br />Chair Thiesse closed the public hearing at 8:44 p.m. <br />
