This application is regarding a conditional use permit (CUP) for a permanent dock <br />installation. <br />2. MN§15.99 Application Deadline. The application was received and was considered to be <br />complete on September 19, 2017. The 60 -Day review period has been extended and now expires <br />on January 17, 2017. <br />Background. The applicant is currently building a new home on the vacant property. In addition, <br />they wish to install a permanent dock. Because of the permanent nature of the dock structure <br />within the floodway, a conditional use permit (CUP) is required. The Lake Minnetonka <br />Conservation District (LMCD) regulates docks on the Lake. A LMCD permit was issued on <br />November 15t; the installation will be done over the winter. <br />4. Planning Commission Comment. On October 16th, the Planning Commission held a public <br />hearing and reviewed the application. Following the public hearing the Commission voted 6 to 0 <br />in favor of a motion to approve with the following conditions: <br />a. The dock shall be allowed as long as it continues to be permitted by the LMCD and DNR <br />and is in conformity with the rules and regulations of those agencies; and <br />b. The dock is not to be used for commercial purposes or rented. <br />5. Public Comment. No comments have been received on this application. <br />6. Staff Recommendation. Staff recommends approval of the CUP to allow the permanent dock to <br />be installed. <br />COUNCIL ACTION REQUESTED <br />Motion to adopt or amend the approval resolution. <br />Exhibits <br />Exhibit A.
