AGENDA ITEM <br />Item No.: 7 <br />Date: November 27, 2017 <br />Item Description: #17-3970, Paul Vogstrom o/b/o William & Sue Dunkley, <br />2709 Walters Port Lane, Variances — Resolution <br />Presenter: Melanie Curtis Agenda Consent Agenda <br />Planner Section: <br />Purpose. This application is regarding variances in order construct an addition to the <br />existing home. <br />2. MN§15.99 Application Deadline. The application was received on August 29,2017; <br />and was considered as complete on September 27th. The 60 -Day review period was <br />extended on October 19th for an additional 60 days; a decision must now be made by <br />January 25, 2018. <br />3. Background. Applications were before the Planning Commission in October relating to a <br />lot line adjustment and a number of improvements to the subject property and the <br />adjacent property (2710 Pence Lane). Since that time the applicants have decided to <br />withdraw their plans for 2710 Pence Lane and combine 2709 Walters Port Lane with <br />2710 Pence Lane in order to construct the desired addition to their home. The <br />applications for the lot line rearrangement, and other variances for 2710 Pence have been <br />formally withdrawn. <br />At this time the applicants are requesting variances for lake setback, average lakeshore <br />setback, and hardcover within the 75 -foot setback which support their proposed addition. <br />The hot tub deck area will become enclosed and roofed and incorporated into the new <br />addition within the 75 -foot setback. Because of the location of the existing home on the <br />lot, the connection will be within the 75 -foot setback area resulting in 130 square feet of <br />new structural and hardcover improvements within the 75 -foot setback where neither are <br />permitted. <br />An average lakeshore setback variance is also requested in order to construct the addition <br />to the home. The existing home is situated entirely lakeward of the average lakeshore <br />setback line; portions of the addition will be entirely lakeward of the average lakeshore <br />setback line established by the homes at 2707 Walters Port Lane and 2715 Pence Lane. <br />4. Planning Commission Comment. On October 16th, the Planning Commission held a <br />public hearing and reviewed the application. Following the public hearing the Commission <br />voted 6 to 0 on a motion deny the variances. Primarily the Planning Commission's <br />recommendation was based on the request, at that time, for new retaining walls and a <br />driving path within the 75 -foot setback. The applicants have since withdrawn that portion <br />of the request. Please refer to the Minutes from the Planning Commission meeting for the <br />discussion. <br />5. Public Comment.
