CITY OF ORONO / ORONO PUBLIC SCHOOLS <br />AMENDMENT NO. 1 TO THE LEASE AGREEMENT <br />THIS AGREEMENT made and entered into by and between the CITY OF ORONO and <br />ORONO PUBLIC SCHOOLS, INDEPENDENT SCHOOL DISTRICT 278, both political <br />subdivisions of the State of Minnesota, hereinafter referred to as the "city" and the <br />"school District," respectively. For purposes of this Agreement, the address of the City <br />is 2750 Kelley Parkway, Orono, Minnesota 55356, and the address of the School <br />District is 685 Old Crystal Bay Road North, Orono, Minnesota 55356. <br />WITNESSETH <br />WHEREAS, the CITY and the SCHOOL DISTRICT are signatories to the Lease <br />Agreement, whereby the CITY subleases the certain County Election Equipment to the <br />SCHOOL DISTRICT; and <br />WHEREAS, the SCHOOL DISTRICT has requested an increase in the number of <br />Election Equipment and AVT Equipment (as defined herein) for use in all School District <br />elections; and <br />NOW THERFORE, IT IS HEREBY AGREED that the Lease Agreement between <br />the herein -named parties is hereby amended in accordance with the provisions set forth <br />below: <br />Sections 1.1 — 1.2 shall be amended to read: <br />SCOPE OF AGREEMENT <br />1.1 The CITY hereby subleases to the SCHOOL DISTRICT at the cost identified <br />below and subject to the terms and conditions of this Agreement, and the <br />SCHOOL DISTRICT herby agrees to sublease from the CITY election <br />equipment identified as: Three (3) DS200 Digital Scan Precinct Count Units <br />(including (6) 4 GB Jump Drives, and three (3) DS200 Plastic Ballot Boxes <br />(the "Election Equipment") for polling places contained within the SCHOOL <br />DISTRICT. <br />1.2 The CITY hereby subleases to the SCHOOL DISTRICT subject to the terms <br />and conditions of the Agreement, and the SCHOOL DISTRICT hereby <br />agrees to sublease from the City Assisted Voting Technology Equipment <br />identified as: three (3) AutoMARK Voter Assist Terminals, six (6) flashcards <br />and three (3) ES&S AutoMARK Tables with adjustable legs for polling <br />places ("AVT Equipment") contained within the SCHOOL DISTRICT. <br />Section 6.1 shall be amended to read: <br />LEASING, PROGRAMMING, AND ACCUMULATION COSTS <br />
