From: <br />Peter Lanpher <br />To: <br />Jeremy Barnhart <br />Cc: <br />Denny Walsh; Victoria Seals; Peter Lanpher <br />Subject: <br />Fwd: Re: Statement and Complaint <br />Date: <br />Wednesday, August 02, 2017 6:23:16 PM <br />Hello Jeremy, <br />Council <br />Exhibit E <br />17-3953 <br />I recently reviewed the planning commission discussion of Monday July 17, 2107 regarding <br />Text Amendment Non -Encroachments. <br />The planning commission was missing the point of the complaint and subsequent discussion <br />as it was not clearly explained to them what the importance of the set back policy is and why it <br />was adopted the many years ago <br />My neighbor, or for that matter any neighbor, on Lake Shore property should obey the 0-75 <br />foot lake shore set back policy. <br />If the City of Orono plans on making an exception to this as the discussion was going then the <br />City of Orono will be in violation of a State Department of Natural Resources policy which all <br />Cities adopted those many years ago. This is under Section 6 of Statewide Shore Land <br />Management Standards. <br />The Shoreland Management Act is a statewide adopted program in the efforts of protecting <br />our rivers and lakes. I believe that it is not open for discussion or change unless the City plans <br />on going to the State Legislature and DNR to try and change this already adopted policy. <br />Enforcement of the Shoreland Management Act once adopted is up to the City. The State <br />DNR will only go the higher level cases. If the City chooses not to enforce then it can be <br />pursued in the courts if necessary. But the policy is clear as to its reasoning and objectives in <br />protecting our waterways. <br />Regarding the Cities hard cover ordinances. As my neighbor is already over extended in their <br />allowance of hard cover and their property is overbuilt any allowance of additional hardcover <br />as noted in my complaint should not be allowed. The discussion the planning commission was <br />having about this matter was confusing enough and going (in my opinion) nowhere because of <br />them not having the pertinent information to make a well informed decision from the <br />discussion. <br />This amendment will be brought to the City Council at their next meeting to vote upon. I hope <br />the entire Council will review this matter with great interest (historical) and its importance. <br />If the Council votes to amend and correct this item as it was originally adopted many years <br />ago from the State then I sincerely hope that the planning commission will be informed as to <br />the reasoning behind this State adopted policy. <br />Thanks for your attention in this matter. <br />Sincerely, <br />Peter <br />
