Purpose. This application is regarding a variance and retaining walls in the lake yard setback. <br />2. MN§15.99 Application Deadline. The application was received on June 21, 2017; it was <br />considered as complete on July 19, 2017. Therefore the 60 -Day review period expires on <br />September 19, 2017. <br />Background. The applicants are requesting a variance to add retaining walls within the 0-75 lake <br />yard setback near the shoreline of the property at 3155 Casco Circle. It has a steep slope along <br />the shoreline and down to the lake. There are currently stairs leading down the slope creating <br />access to the lake. The applicant is proposing the replace the stairs in-kind and is asking to install <br />additional retaining walls to strengthen the slope down to the lake. The applicant will be working <br />with the Minnehaha Creek Watershed District to obtain riprap permits. The new riprap will abut <br />the neighboring properties existing riprap. <br />4. Planning Commission Comment. On August 21, 2017, the Planning Commission held a public <br />hearing and reviewed the application. Following the public hearing the Commission voted 7 to 0 <br />in favor of a motion to approve with the following conditions: <br />a. Submittal of engineered plans with the Building permit application; <br />b. Approval applicable permits from the MCWD; <br />c. Vegetative screening plan to provide a natural looking slope when viewed from the lake; <br />d. Removal of the wall directly above the rip rap, or if necessary to the stability of the slope, <br />the applicant should provide justification and a revised plan which allows for vegetative <br />screening of the bottom wall. Without justification, staff recommends denial of this wall. <br />Public Comment. No comments from the public were received regarding this application. The <br />applicant was present for questions. No comments have been received after the meeting. <br />6. Update. The applicant has updated their plans to address the conditions of the Planning <br />Commission's approval. The new plans show the removal of the linear retaining wall along the <br />shoreline and shows new added vegetation for screenings of the proposed retaining walls. <br />7. Staff Recommendation. Staff recommends approval with the condition that the applicant <br />address the following: <br />a. Submittal of engineered plans with the Building permit application; <br />b.
