MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, August 21, 2017 <br />6:30 o'clock p.m. <br />Fretham stated they are planning to do a thorough analysis of the road independent of what the City does, <br />and if the road is damaged, they will be accountable, but they will know what it looked like before they <br />start. <br />Fretham stated even though the sewer and gas lines are on the subject property, they are not in their way <br />and they are not planning to do anything about it. <br />Thiesse asked if he would give the Whites some sort of easement to repair. <br />Fretham stated that depends. <br />Schoenzeit asked if there is any existing easement for that. <br />Thiesse stated the City is not aware of one. <br />Fretham stated there will be an easement on their side. <br />Schoenzeit noted the other property does not have to grant an easement as part of this project. <br />Fretham stated as it relates to the wetland and the wetland buffer area, the Lupients, in granting this <br />restoration easement, created their own burden by creating a wetland and a restoration easement along the <br />property line that is in conflict to their own interests to the property. Fretham stated the Lupients gave <br />that up and that they are now expecting a variance to the easement will be needed. <br />Thiesse asked if the City was provided with that easement. <br />Barnhart stated he did not provide it to the Planning Commission but that the City does have possession <br />of it. <br />Dampier stated when he was getting his building permit, the City explained that the house to the north <br />was exempt because it was a pre-existing nonconforming structure.
