MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, August 21, 2017 <br />6:30 o'clock p.m. <br />Dampier stated at a bare minimum, if this is allowed and barging is not required, the City should demand <br />some type of surety bond or warranty to ensure that any damage to the road will be addressed by the <br />developer. Dampier stated the congestion from construction crews and equipment will bring further <br />problems and damage to the neighborhood. <br />Mark Pfleghaar, 3509 Ivy Place, stated he would second what Frenchie said about traffic and the <br />condition of the road. Pfleghaar stated there are a lot of kids on the road and that the road can barely pass <br />two vehicles right now. <br />Pfleghaar stated he is not sure if anyone talked to Jim White about why this lot was never developed <br />before but to allow somebody variances for financial gain is senseless. If the Lupients wanted to retire <br />there and build their dream home, the neighborhood would be a lot more supportive of anything <br />happening at all. Pfleghaar stated when he presented some things to the Planning Commission and City <br />Council, he was told that financial gain is not a reason to grant a variance. Pfleghaar stated the developer <br />is building the homes for a profit and that he wants to go outside the rules of the City to do that, which he <br />does not believe is fair. <br />Peter Graff tinder, 3630 Casco Avenue, stated he is not close to this site and not impacted by the work but <br />that he has great concerns about filling wetland. Graffunder noted earlier photographs depict this area as <br />all wetland and that it has already been filled somewhat. Graffunder stated he is not sure whether the <br />filling was permitted or not. Graffunder stated the mitigation of a 165 -foot wetland is a ridiculous amount <br />since virtually all of the site is wetland. <br />Dave Pichotta, 2914 Casco Point Road, asked if there have been soil borings done of these lots and <br />whether the Planning Commission or City Engineer has reviewed them. Pichotta stated he stood on his <br />lot near the shoreline by the high water mark from a few years and that entire peninsula was under water. <br />Pichotta commented it seems ludicrous to him that the City would allow building on there, but what is <br />more ludicrous is that the County and the City have been taxing the Lupients for developable lots for so <br />long. <br />Jeff Danberry, 3545 Ivy Place, asked why they want access across Jay's driveway. Danberry asked if that <br />access has already been granted and whether it is for a walkway or for vehicles. <br />Page 8 of 19 <br />
