JHG PROPERTIES, LLC <br />12700 Anderson Lakes Parkway <br />Eden Prairie, MN 55344-7652 <br />July 31, 2017 <br />City of Orono <br />City Council <br />2750 Kelley Parkway <br />Orono, MN 55356 <br />E-mail address: <br />JHGilbert@lawgilbert.com <br />Re: Waiver of Conservation Design Requirements for 4035 Dahl Road Lot Subdivision <br />Dear City Council <br />Let this letter serve as JHG Properties' official request for a waiver from the <br />Conservation Design requirements set forth in Chapter 78, Article XII of the Orono City Code. <br />In light of the size and nature of this subdivision application, we request a waiver of the <br />conservation design plan which appears to be suited for larger sub -division projects involving <br />major earthmoving, new streets, sewer, etc. None of these major disruptive activities will take <br />place on either of the two proposed lots if the variance and subdivision are approved. All <br />necessary roads and sewer are already connected to the property and the proposed driveways will <br />simply be connected to existing Dahl Road and become part of the existing neighborhood. <br />We plan on leaving undisturbed all of the trees and brush growth on the perimeter of the <br />property and the major pine trees that are on the property. Two of the pine trees were damaged <br />in the recent storm and broke off and will be removed when the existing home is removed, along <br />with the scrub trees and bushes that have grown around the home. <br />We requested a quote for a conservation design and the estimate was between $5,000 and <br />$7,000 for this simple lot split. We have already spent considerable sums on the wetland <br />delineation process, and the wetland area will of course always be protected from any <br />development or alteration both now and into the future. <br />Please do not hesitate to contact me if you have any questions or need any additional <br />information and thank you for your consideration. <br />
