FILE # 17-3943 <br />June 19, 2017 <br />Page 5 of 5 <br />Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Practical Difficulties Analysis <br />The purpose for the roof mounted requirement, coupled with hard cover and structural <br />limitations, appears to minimize light and glare impacts on adjacent properties. The proposed <br />location of the solar array is within a heavily screened area of the yard, maintaining setbacks from <br />adjacent property lines. Further, a ground mounted array will be screened from Stubbs Bay road. <br />The nearest adjacent home, 3625 Jacobs Mill Road, is 375 feet from the array. <br />State statute seems to clearly protect a property owners' interest in solar energy. Placing of the <br />array on the home would not negate the need for a variance, as due to the roof slope, and <br />orientation, a variance would be required not be flush with the roof. <br />Public Comments <br />To date, no public comments have been received. <br />Issues for Consideration <br />1. Does the Planning Commission find that that the property owner proposes to use the <br />property in a reasonable manner which is not permitted by an official control? <br />2. Does the Planning Commission find that the variance, if granted, will not alter the <br />essential character of the neighborhood? <br />3. Does the Commission find it necessary to impose conditions in order to mitigate the <br />impacts created by the granting of the requested variance(s)? <br />4.
