(reserved for recording information) <br />ENCROACHMENT AGREEMENT <br />AGREEMENT made this � day of l- , 2009, by and between the <br />CITY OF ORONO, a Minnesota municipal corporation ("City"), and Shawn Foy, a single person <br />("Landowner"). <br />RECITALS <br />A. Landowner is the fee owner of certain real property located in the City of Orono, <br />Hennepin County, Minnesota, hawing a street address of 3345 Crystal Bay Road, Minnesota and <br />legally described on the attached Exhibit "A" ("Subject Property"). <br />B. The Subject Property abuts a street right-of-way easement owned by the City C'Right- <br />of-Way Area"). <br />C. Landowner desires to install riprap along the shoreline of Lake Minnetonka, located <br />within the Right -of -Way Area. <br />NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS <br />THE PARTIES AGREE AS FOLLOWS: <br />1.
