Date Application Received: 04/19/17 <br />Date Application Considered as Complete: 05/13/17 <br />60 -Day Review Period Expires: 07/02/17 <br />To: Chair Thiesse and Planning Commission Members <br />Doug Reeder, Interim City Administrator <br />From: Melanie Curtis, Planner YYIGG <br />Date: 15 May 2017 <br />Subject: #17-3939, John Bailey, 2807 Casco Circle, <br />Conditional Use Permit <br />Public Hearing <br />Application Summary: The applicant is requesting a CUP in order to repair a 2014 lake slope <br />failure which exceeds 500 cubic yards of imported and exported material. <br />Staff Recommendation: Planning Department Staff recommends approval of the CUP with <br />conditioned upon an engineer certifying the plan. <br />Background <br />The property owner is requesting a conditional use permit in order to repair and restore slope <br />failures which occurred in his lake yard. In July of 2014, with a number of other properties <br />around the lake, the property suffered catastrophic failures of their 40 foot high lake slope. <br />Since that time he has been trying to develop a restoration plan that meets both the City's goals <br />to stabilize the slope in a natural way, if possible, and stop the sedimentation into the lake; and <br />his goals for stability, aesthetics, and lake access. The property owner has recently provided the <br />City with a plan to restore his lakeshore slope. The project involves removal of the disturbed <br />soil; sawtooth cutting the subgrade; and installation of: new compacted soil, a yard drain, <br />drainage pipe, Filtrexx living slope stabilization pods, and stabilizing vegetation. <br />A conditional use permit is required to authorize the work on the property as the restoration <br />work will exceed 50 cubic yards of material within the 0-75' zone. <br />Applicable Regulations: <br />Conditional Use Permit (Sections 78-967; 78-1283; 78-1285; & 78-1286) <br />The scope of the project will be limited to the area within 75 feet of the OHWL. In order to <br />stabilize the slope the applicant is proposing to remove approximately 300 cubic yards of <br />compromised soil material and replace it with approximately 500 cubic yards of angular soil to <br />be compacted and restored as shown on the plans. <br />Applicable Regulation: Conditional Use Permit (Section 78-916) <br />The Planning Commission may recommend and the Council may grant a Conditional Use <br />Permit (CUP) as the use permit was applied for or in modified form. On the basis of the <br />application and the evidence submitted, the city must find that the proposed use at the <br />proposed location is or will be: <br />
