AGENDAITEM <br />Item No.: 22 <br />Date: June 12, 2017 <br />Item Description: #17-3939, John Bailey, 2807 Casco Point Road, Conditional Use <br />Permit <br />Presenter: Melanie Curtis Agenda Planning Department <br />Planner Section: Report <br />Purpose. To consider an application for a conditional use permit to repair a lake slope failure. <br />2. MN§15.99 Application Deadline. The application was received on April 19, 2017; and <br />considered as complete on May 13. The 60 -Day review period expires on July 2, 2017. <br />Background. The property owner is requesting a conditional use permit in order to repair and <br />restore slope failures which occurred in his lake yard in June/July of 2014. The property owner <br />has recently provided the City with a plan to restore his lakeshore slope. The project involves <br />removal of the disturbed soil; sawtooth cutting the subgrade; and installation of.- new compacted <br />soil, a yard drain, drainage pipe, Filtrexx living slope stabilization pods, and stabilizing <br />vegetation. <br />A conditional use permit is required to authorize the work on the property as the restoration work <br />as proposed will exceed 50 cubic yards of material within the 0-75' zone. The applicant is <br />proposing to remove approximately 300 cubic yards of compromised soil material and replace it <br />with approximately 500 cubic yards of angular soil to be compacted and restored as shown on the <br />plans. <br />The plans provided by the Applicant indicate that the proposed improvements include detailed <br />and complex solutions to deal with site drainage and slope stabilization; the scope of work <br />includes infrastructure along with grading and vegetation. Due to the sensitivity of the slope, staff <br />requested as required by Section 78-1283, additional supporting engineering for the mechanical <br />drainage system; the applicant has not provided this information. <br />4. Planning Commission Comment. On May 15, the Planning Commission held a public hearing <br />and reviewed the application. Following the public hearing the Commission voted on a motion to <br />recommend approval of the requested CUP conditioned upon submittal of a soil boring report <br />and/or the slope stability analysis, and an engineer's opinion or certification on the drainage <br />calculations used for the sizing of the drainage structures for the subsurface drainage system. <br />5. Public Comment. Mr. Frommelt, a neighbor, spoke at the Planning Commission meeting. No <br />additional comments from the public were received regarding this application. <br />6. Staff Recommendation. The applicant has provided the additional documentation requested by <br />the Planning Commission (Exhibit B). See the City Engineer's comments attached as Exhibit E. <br />Staff recommends approval of the grading plan as proposed; further staff continues to recommend <br />the drainage solutions be certified by a licensed professional engineer. Staff recommends <br />direction to draft a resolution for approval or denial, and if a waiver of additional information is <br />deemed appropriate findings to that effect. <br />COUNCIL ACTION REQUESTED <br />Council should direct staff to draft a resolution reflecting your decision to be adopted at the June 26' <br />meeting.
