AGENDAITEM <br />Item No.: 17 <br />Date: June 12, 2017 <br />Item Description: #17-3938, TC Homes, Inc., (Brian Tutt) o/b/o Nancy Bloms, <br />1325 Rest Point Lane, Variances: Lot Area, Lot Width, Street Side yard setback <br />Presenter: Jeremy Barnhart, Community Agenda Consent Agenda <br />Development Director Section: <br />1. Purpose. The purpose of this action item is to review a variance application from the side street <br />setback and lot size and width requirements to permit the construction of a new home. <br />2. Minnesota Statutes 15.99 Deadline. This application must be acted on by June 19, 2017 <br />3. Background/ Summary. The property has been vacant for a number of years. The property owner is <br />selling to a buyer who proposes a two story, 1686 square foot (footprint) single family home. The lot is <br />non -conforming as to width and area, the applicant requests a variance from the required side street <br />setback, as well as variances from the lot width and area requirements. The side street in question is <br />unimproved right of way, but used to provide access to the two lots to the west. <br />4. Planning Commission comment. The Planning Commission reviewed the request at the meeting on <br />May 15, 2017. Commissioners questioned subsurface drainage issues raised by neighboring property <br />owners, which is noted for the property owner. Commissioners felt the home was appropriate for the <br />neighborhood, and that a desire to keep the property vacant is not a basis for denial. <br />5. Public Comment. Two written comments have been received. At the public hearing, 3 persons spoke, <br />two neighbors to the west, in opposition, and one, the owner, in support, Neighbors had concerns with <br />private improvements made on the vacant property, including retaining walls and irrigation systems, and <br />drainage patterns impacting their homes. The owner commented that the property has been for sale a <br />number of years and purchase was an option. <br />6. Staff Recommendation.
