The unique shape and peninsula qualities of the Property are not <br />common in the surrounding neighborhood. <br />10. The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. Granting the requested variances will provide <br />relief to the applicant regarding the lot shape, topography, and possible wetland on the <br />property. <br />11. The granting of the proposed variance will not in any way impair health, safety, comfort <br />or morals, or in any other respect be contrary to the intent of this chapter. Granting the <br />requested variances will not adversely impact health, safety, comfort, or morals; nor <br />will it be contrary to the intent of the Code. <br />12. The granting of such variance will not merely serve as a convenience to the applicant, but <br />is necessary to alleviate demonstrable difficulty. The shape and orientation of the <br />Property; the topography and possible wetland create practical difficulties affecting the <br />Property; the variances are necessary and not merely serve as a convenience to the <br />owners. <br />The Commission may recommend or Council may impose conditions in granting of variances. <br />Any conditions imposed must be directly related to and must bear a rough proportionality to the <br />impact created by the variance. No variance shall be granted or changed beyond the use <br />permitted in this chapter in the district where such land is located. <br />Septic System Status <br />The property is served by City sewer. <br />Practical Difficulties Statement <br />Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Practical Difficulties Analysis <br />The most inconspicuous and logical location for the generator and pad is where it is proposed. <br />The improvement will be accessed by the existing secondary driveway; City's sewer and lift <br />station improvements are approximately 50 feet to the east within an easement on the property <br />and set closer to the area identified as a possible wetland. From the lake the improvement will <br />be completely screened by the rest of the property itself. Due to the height proposed at less <br />than 3 feet it will likely not be visible from Ferndale Road West without difficulty. Moving the <br />improvement further from the lake would result in locating it within an area of steep slope <br />causing a greater disturbance of the site. The wetland and lake setback variances are supported <br />by the site constraints. <br />Engineer Comments <br />The City engineer has not reviewed the proposal. A complete review will be conducted at the time <br />of permit. <br />Public Comments <br />To date, no public comments have been received. <br />
