MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, May 8,2017 <br />7:00 o'clock p.m. <br />14. #17-3910 LAKE WEST DEVELOPMENT, LLC, 3245 WAYZTA BOULEVARD WEST, <br />INTERIM USE PERMIT: TEMPORARY USE FOR CONSTRUCTION STAGING. — Continued <br />5. Construction of a proposed permanent screening berm along the south and southwesterly <br />boundaries of the site will require conditional use permit application and approval. <br />6. An ongoing 6 -month review of the interim use permit shall be conducted to determine whether the <br />use remains acceptable during the duration of the Wayzata boulevard improvement project. <br />In terms of public comments, at both the March and April meetings, public comments were received from <br />Alan Engleman generally in opposition to the use of residentially zoned lands for what he sees as a <br />commercial/industrial use. The minutes from both those meetings have been included in the Council <br />packet. In addition, a letter was received from the Dumas family, who owns the apple orchard to the east, <br />objecting to the proposed use at the Eisinger site which abuts their property. <br />The interim use standards require that an IUP request be considered with respect to the conditional use <br />permit standards of the Zoning Code. Staff s report contains an analysis of the conditional use permit <br />requirements. The requirements address a number of issues. Gaffron recommended the Council review <br />those requirements and see whether they are in agreement. The analysis also discusses consistency with <br />the City's Comprehensive Plan, adequacy of service by police, fire, and stonn water management, etc. It <br />also addresses compatibility with the surrounding area, the need for screening, and the impacts to traffic <br />and lighting. <br />hi the draft IUP ordinance text, there are three specific pieces of information that are required to be <br />submitted, and are as follows: <br />I Written documentation that includes a complete description of the use, schedule for <br />commencement and termination of the use, hours and dates of operation, and anticipated <br />employment. <br />2. Any special studies requested by the City when there is evidence that the proposed use may <br />negatively impact public infrastructure, the environment or adjacent land uses. These studies <br />may examine the impacts on such things as traffic, environment, wetlands and utilities. <br />Evidence of approval or preliminary approval from all other agencies with jurisdiction over <br />elements of the use. <br />The Council should review the information provided and discuss with the applicants any items of note as <br />well as any additional concerns of the Council. If the Council determines that an IUP for this site should <br />be granted, Staff should be directed to draft a resolution for consideration incorporating the <br />recommendations made by the Planning Commission and any other conditions the Council determines are <br />necessary. If the Council determines that more information is required, the application may be tabled and <br />direction given to Staff and applicant. If Council determines that an I-UP should not be issued for this site, <br />the application should be denied. <br />Seals asked where this property is located. <br />Page 12 of 34 <br />
