This application is regarding a conditional use permit (CUP) for grading and filling <br />activities. <br />2. MN§15.99 Application Deadline. The application was received and considered complete on <br />March 22, 2017. Therefore the 60 -Day review period expires on May 21, 2017. <br />Background. The applicant is requesting a CUP in order to conduct grading and filling activities <br />on the property to support the construction of a new residence. They propose fill on the property <br />to accommodate a first floor garage; the site currently includes a home with a tuck -under garage. <br />The grading and filling activities will be in excess of 500 cubic yards of material and the property <br />is located within the Shoreland Overlay District, therefore a CUP is required. The proposed <br />redevelopment of the property will conform to all applicable zoning regulations; no variances are <br />requested. <br />4. Planning Commission Comment. On April 17', the Planning Commission held a public hearing <br />and reviewed the application. Following the public hearing the Commission voted 6 to 0 on a <br />motion to approve the CUP with the following conditions: <br />a. The applicant must comply with the City's and MCVv'D's erosion control regulations. <br />b. Conformance with the City Engineer's requirements at the time of the building permit. <br />c. Hauling shall occur during allowed construction hours only Monday through Friday 7 am <br />to 8 pm (and between 8 am and 8 pm on weekends and holidays). <br />d. The street swept daily, or as needed, to keep debris off of Casco Point Road. <br />e. Contractor shall post a contact number and be able to respond to complaints in a timely <br />fashion. <br />5. Public Comment. No additional comments from the public were received. <br />6. Staff Recommendation.
