I MEMORANDUM Yor April 5, 2017 PC Work session) <br />To: Planning Commission PC Exhibit C <br />From: <br />Mike Gaffron, Senior Planner <br />Date: <br />March 2 8, 2017/h#'�'- <br />Subject: <br />Consideration of Interim Use Text Amendment <br />At your March 20 meeting, Planning Commission tabled applications 17-3810 & 17-3811 <br />regarding the proposed construction staging use at 3245 Wayzata Boulevard, pending ftirther <br />consideration of the "Interim Use Permit" (IUP) concept as well as the actual intended use for the <br />site. The intent of this memo is primarily to review the advantages and potential disadvantages of <br />amending the Zoning Code to allow for Interim Uses. <br />As noted in the March 20 staff report, remember that while a conditional use permit is permanent, <br />and runs with the land, an interim use permit is intended to be temporary. It provides for <br />4sunsetting' a use that may be appropriate for some temporary time period but is not generally <br />appropriate on a permanent basis. <br />In considering whether Orono should adopt an Interim Use ordinance, it may be useful to identify <br />examples where a temporary use may be reasonable, but is not appropriate at a given location on <br />a permanent basis. Examples found in other Minnesota cities' codes are typically tied to specific <br />zoning districts. While there arc some consistencies, it also appears that every City has its own <br />ideas of what to regulate via IUP. In some instances cities are using IUPs to regulate activities or <br />uses that Orono has historically regulated as permitted, conditional or accessory uses, or even via <br />licensing. <br />Here are some examples of what other cities are regulating via Interim Use Permits: <br />Plymouth: <br />Commercial dog kennels as a secondary use. <br />Landfilling and land excavation/grading operations involving over 1,000 cubic yards and <br />mining operations, as regulated by Section 21185. <br />Living quarters which are provided as an accessory use to a principal permitted or <br />conditional use listed, which are located within the principal building, provided that: 1) the <br />living quarters shall not be used as rental properties; 2) a maximum of one such living unit <br />shall be allowed; and 3) there shall be a demonstrated and documented need for such a <br />facility (e.g. nanny, caretaker, security). <br />Agriculture, nurseries, greenhouses for growing only, landscape gardening, and tree fanns, <br />including sales of only those products grown on the premises. <br />Temporary classroom structures for use by public or private schools. <br />Afedina: <br />Single family detached dwellings in the Rural Commercial Holding District <br />Within the Uptown Hamel districts: <br />(1) Residential dwellings which do not meet the minimum density requirements of the <br />Uptown Hamel districts. <br />Page I of 5 <br />
